This case confuse...Thank you so much for this post. This case confuses the hell out of me. <br /><br />I guess in the Zambrano case they felt it was OK to piss off Member States about adopting a very broad scope of competence because there were children involved, and not granting the parents parallel rights would have meant that the children actually had to leave the EU (so the citizens would have had to).<br /><br />Whilst in McCarthy the EU citizen did not have to leave, so her rights as EU citizen weren't being infringed upon, and intervention in domestic immigration laws would be seen as unacceptable if the case only involves an adult. Right? Didn't this happen in 'Akrich'? I mean could McCarthy still obtain residence for her husband in the UK under Right to family life in the European Convention? (I assume not under the Charter because this doesn't concern EU institutions). <br /><br />And it doesn't really contradict Metock because the citizens that the asylum seekers married had previously exercised their free movement rights... no?
